The Protection of Children from Sexual Offenses Act, Act and relevant rules (November 14, 2012) (POCSO) has been implemented by the Government of India to prevent increasing sexual crimes against children. Children below the age of 18 have been included in the Protection of Children from Sexual Offenses Act, 2012. The Act deals with all types of sexual harassment of children (boys/girls), serious sexual harassment, sexual exploitation/violence, sexual harassment, showing pornography, getting children to do pornographic acts, obscene comments and abuses, maintenance of pornographic material and children Provides protection against trafficking of children for sexual exploitation/exploitation including trafficking. In this Act, various important responsibilities have been assigned to the local police and special juvenile police units.
         In pursuance of Rule 4(2) (a) the Child Welfare Officer shall immediately register a First Information Report (FIR) under 154 Cr.P.C. in addition to various sections of this Act. Relevant provisions of IPC, Juvenile Justice Act, Information Technology Act, Scheduled Caste-Tribe (Prevention of Atrocities) Act will also be added.
     The Investigating Officer/Child Welfare Officer shall ensure that the D.P.No. Statement under 164 within 30 days of registration of the case by the concerned Court/Court in the presence of the family of the aggrieved child/any other person in whom the child has trust and confidence/representative/support of the NGO concerned, individual/special educator/Translator will be taken in the presence of the person nominated by the Child Welfare Committee. Under Section 37 of the Act, the case will be disposed of in one year by ensuring in camera trial of the cases by the concerned court. The Superintendent/Deputy Commissioner of Police will follow the prescribed procedure by adding relevant sections of the Protection of Children from Sexual Offenses Act, 2012 in child sexual crime cases committed after November 14, 2012, in which police investigation is on.
Whoever being on the Management or on the staff of a Jail, remand home, protection home, observation home, or other place of custody or care and protection established by or under any law for the time being in force, commits penetrative sexual assault on a child, being inmate of such Jail.
