It may be necessary to clarify that the appellant no. 1 herein, 'Just Rights for Children Alliance is a collation comprising of five different NGOs that work in unison against child trafficking, sexual exploitation and other allied causes. Whereas the appellant no. 2 is a child rights organization working Towards protection children from exploitation and one of the partner NGOs to the aforesaid collation. The appellants herein were not a party to the proceedings before the High Court. However, having regard to the serious issue of public importance involved in the matter they sought leave of this Court to challenge the impugned judgment of the High Court The respondent are the State of Tamil Naidu and the Inspector of Police, All-Women's Police Station Ambattur, Chennai, respectively. In the light of the above discussion, the continuation of the proceedings against the petitioner will amount to abuse of process of Court. That apart, it will be a stumbling block for the petitioner's career in future. Therefore, this Court is inclined to quash the proceedings in on the file of the Sessions Judge, Mahila Neethi Mandram Tiruvallur District.Respectfully, I cannot bring myself to traverse the same path. After almost months the judgment came to be reserved, it pricks my conscience to send the matter back once again to an appropriate bench; more so, after both sides have exhaustively addressed us on the very issue as to whether AMU answers the characteristics of a minority institution. In present times, when there is a lot of emphasis on pendency of cases and expeditious disposal thereof, precious judicial time would be wasted if the same issue has to be agitated yet again when such time could be well utilised in answering other pressing question of law. I feel the urge to decide here and now, bases on whatever indicial we identify or formulate, as well as the circumstances - antecedent, attending and surrounding of the relevant time, as to whether is a minority educational institution or not. I feel equipped to do so on account of extensive evidence having already been led by both sides.
