The petitioners have filed this petition being aggrieved by the cancellation and withdrawal of their mark sheets of B.A.IInd Year examination which was held in March, 2009.The facts leading to the filing of the present petition are that the petitioners being regular students participated in B.A.IInd Year examination held by the respondent No. 1 in March, 2009 and were declared passed and were permitted to attend the B.A. Final Year classes till 24-10-2009 on which date suddenly the respondent No. 2 served new mark sheets on the petitioners wherein petitioners No. 1 to 3 were declared to have obtained supplementary in Sociology and petitioner no.4 was declared failed in the subject of Sociology Paper-I. It is also undisputed that subsequently in view of cancellation of Sociology Paper-I examination all the students including the petitioners were permitted to participate in the examination of Sociology Paper-I held by the respondent No. 1 and the petitioners No. 1 to 3 have been declared passed. It is submitted by the learned counsel appearing for the petitioners that in view of the aforesaid nothing survives in respect of the grievance of the petitioners No. 1 to 3 as they have been declared pass and have also been permitted to participate in B.A.Final Year examination which is to commence from 19-3-2010.It is, however, stated that the petitioner No. 4 in the initial examination had been declared pass by grace as he had obtained 49 marks in the subject of Political Science which was one mark less than the passing marks and on that account had been given one grace mark and had been declared pass but subsequently he was declared fail in the subject of Sociology and Political Science as the grace mark given to him in the subject of Political Science was withdrawn and on that account he was declared failed. It is further submitted that in view of the interim order passed by this Court petitioner no.4 was permitted to appear in the Sociology Paper-I examination alongwith all other students and it is submitted that in case the result is declared he would successfully clear the paper and in such circumstances he be permitted to participate in B.A Final year examination alongwith all other students after re-according him one grace mark in Political Science.
