He had also recorded the certificate to the effect that Firoza Bi was fully conscious during the time of making her statement. In Ex. By the time she reached near the door, her whole body caught fire. When she went out, people covered her with a quilt. At the time of occurrence, her sister Salma and Jithani Sahina were present. Her husband had gone for working on loom. She stated that her father-in-law and mother-in- law used to ask her to leave their house, but where they could have gone, her husband was a labourer. Her mother-in-law was the step mother-in-law. She had studied up to 5th Class. This statement was signed by the deceased and also by Dr. K.M.Gupta (PW5). Dr. K.M.Gupta (PW5) stated that after getting the treatment started he had gone, but after about 3 ½ hours, on the request of police, he had come back to record the dying declaration. At that time, relative men and women of Firoza Bi were present beside her bed and she was talking to them. When he started recording the dying declaration, he asked all these persons to go out of the room. He admitted that Firoza Bi named only her mother-in-law and she did not tell anything about her father-in-law. He did not know as to who were the persons who had stayed and talked with her.
