That, it is submitted that , THE APPLICANT BANK has FILED THE INSTANT ORIGINAL APPLICATION for RECOVERY of Rs. 30,14,907=65 together with interest and other reliefs as claimed there in AGAINST the defendants. 2. That, it is submitted that, the defendants have filed their reply to the Original Application wherein certain incorrect facts have been mentioned by them which has NECESSITATED filing of the rejoinder as under. PRELIMINARY SUMMISSIONS PARA1. That the contents of Para 1 of the Preliminary Submissions is denied and require clarification. TIA IS SPECIFICALLY DENIED that the present Original application is hit by Order 30 of C.P.C. it is submitted that the said firm is proprietorship firm not PARTNERSHIP FIRM. The allegation. made by the defendants in this Para is not relevant of which provision mention by them. ALL OTHER ADVERSE ALLEGATIONS MADE IN THIS PARA OF THE REPLY ARE SPECIFICALLY DENIED. PARA2.: That the contents of Para 2 of the preliminary Submissions is denied and require clarification. It is submitted that the bank has charged present and future interest as power the guidelines/norms of reserve bank of India. It is specifically denied that the Bank has adding the interest at the exorbitant rate as also monthly rest. ALL OTHER ADVERSE ALLEGATIONS MADE IN THIS PARA OF THE REPLY ARE SPECIFICALLY DENIED. PARA3: That the contents of Para 3 of the Preliminary Submissions is denied and require clarification. The applicant Bank is denied and requires Clarification. The The Bank fill up the Loaning Documents in presence of the defendants and after examine the documents they signed the same. The terms and condition mentioned in the sanction letter were duly accepted by the defendant and thereafter they executed the further Loaning Documents. It is Specifically denied that the bank his obtained the signatures on some Blank printed forms. All others adverse allegations made in this Para of the reply are specifically denied.
